Terms of Service

Last updated:

These terms govern your use of Wingo Marine — the marine.wingo.ro website, the app, the public ship directory and the API. Please read them before you create an account. By creating an account or using the Service you accept them.

1.Who we are

Wingo Marine (the “Service”) is operated by FREEVOX S.R.L. (“Freevox”, “we”), part of the Wingo family of products:

  • Registered office: Str. Crăițelor 2B, room 2, Otopeni, Ilfov County, 075100, Romania
  • Office and correspondence: Șos. București–Ploiești 19, Băneasa Business Center, Sector 1, Bucharest, Romania
  • Tax ID (CUI): 43636649 · Trade Register no.: J23/494/2021 · EUID: ROONRC.J23/494/2021
  • Share capital: [DE COMPLETAT: subscribed and paid-up share capital, per the ONRC certificate]
  • Email: office@freevox.ro · Phone: +40 770 348 017

“You” or the “User” means the person who creates an account or uses the Service. If you use the Service on behalf of a company, you confirm you may represent it, and these terms apply to that company.

A “Consumer” is an individual acting for purposes outside their trade, business, craft or profession. A “Business” is anyone else. Some clauses apply differently to consumers — they are marked as such.

2.What the Service offers

Wingo Marine shows information about ships and ports based on the AIS (Automatic Identification System) messages ships broadcast publicly. Depending on your plan, the Service includes:

  • the live global map with current vessel positions, and ship and port search;
  • the public ship and port directory (the pages under /ships, /ship and /port);
  • fleets (watch lists of vessels), track history and signed webhook alerts;
  • on-demand position checks of a vessel from a third-party tracking source;
  • the public REST API (/api/public/v1), authenticated with API keys and paid in credits.

The data comes from the global AIS stream provided by aisstream.io, from public AIS receiver stations run by third parties and from other public ship-tracking sources. We do not own the global AIS feed and do not control what ships broadcast.

3.AIS data: important limits

  • Coverage is uneven. Some areas (the North Sea, for example) have dense reception, others (the open ocean, parts of Asia or Africa) very little; a ship may be missing or show a position that is hours or days old.
  • Data can be wrong. AIS messages are entered and broadcast by the ships; they can contain errors, be incomplete, delayed or spoofed. Identity, type, dimensions, destination and ETA are as declared by the ship.
  • Some sources carry no MMSI. For data taken from third-party sources the vessel is matched automatically by name and position; a match can be wrong, which is why we apply plausibility checks and hide unconfirmed results.
  • History is sampled. We do not keep every message in the history; tracks are rebuilt from sampled positions.
  • On-demand checks return the latest position available at a third-party source; it can be older than you expect and is only used when it is newer than the stored one.

4.Your account

  • You must be at least 18 years old and have full legal capacity to create an account.
  • You provide real, current details (name, email address) and confirm your email address through the link we send. You can also sign in with a Google account when that option is enabled.
  • You are responsible for keeping your password and API keys confidential and for all activity in your account. Tell us at office@freevox.ro straight away if you suspect unauthorised use.
  • An account belongs to a single person or company. Do not create several accounts to collect the free credits more than once or to get around limits.
  • “Remember me” keeps you signed in on that device (30 days by default); do not use it on shared devices.

5.Plans, credits and prices

The free account

Creating an account is free and needs no card. The free account includes the live map, search and the ship directory. When you confirm your email address you may receive a one-time credit bonus, in the amount shown when you sign up.

Paid plans

Paid plans (for example Starter, Pro, Business) are monthly subscriptions. Each plan includes a number of credits per month, limits for fleets and webhooks, and features such as track history. What each plan includes and costs is what the pricing page shows when you order.

Credits

  • Each public API call and each on-demand check costs a number of credits, published on the pricing page and in the API documentation; the remaining balance comes back with every response.
  • Monthly plan credits reset at every subscription renewal: credits not used in a period do not roll over.
  • Top-up credits are bought once and do not expire for as long as the account exists. The sign-up bonus is also top-up credit.
  • Monthly credits are spent first, then top-up credits. When both are used up, the API answers 402 until the renewal or a top-up; we never bill overage.
  • Credits have no cash value, cannot be transferred and cannot be exchanged for money, except for the refunds described under “Cancellation, withdrawal and refunds”.

Prices and VAT

Prices are in euro (EUR) and are those shown on the pricing page. At the date of this version FREEVOX S.R.L. is not registered for VAT, so the prices shown are final, with no VAT added. [DE COMPLETAT: confirm the VAT treatment — e.g. for VAT-registered business customers in other EU countries (reverse charge) and the EUR 10,000 threshold for distance sales to EU consumers (OSS)]

We may change plan prices. For running subscriptions we will email you at least 30 days in advance; the new price applies from the next renewal, and if you do not agree you can cancel before then.

6.Payment and invoicing

  • Payments are processed by Stripe (Stripe Payments Europe, Ltd., Ireland) on the secure Stripe Checkout and Stripe Customer Portal pages. You enter your card details directly with Stripe; Freevox never sees or stores your card number.
  • Subscriptions are paid monthly in advance and renew automatically at the end of each period until cancelled. The amount is charged at the start of each billing period.
  • Credit packs are a one-time payment; the credits are added to your account once Stripe confirms the payment.
  • If a payment fails, Stripe may retry it. Until it is paid we may suspend the features of the paid plan; the free account and your top-up credits stay available.
  • Invoices: [DE COMPLETAT: how the tax invoice is issued — e.g. through Stripe Invoicing or an invoicing program, sent by email and, for Romanian companies, through RO e-Factura]. Payment receipts are emailed by Stripe.

7.Cancellation, withdrawal and refunds

Cancelling a subscription

You can cancel your subscription at any time from the Billing page of your account (through the Stripe Customer Portal). Cancellation takes effect at the end of the period already paid: until then you keep the plan’s features, then the account returns to the free plan. Top-up credits stay in the account.

Right of withdrawal (consumers only)

If you are a consumer, you may withdraw from the contract within 14 days of concluding it, without giving a reason (Romanian Government Emergency Ordinance no. 34/2014). To do so, send us a clear statement at office@freevox.ro (you may use the model form in Annex 2 to that ordinance).

  • Subscriptions: by completing the payment you ask us to start providing the Service immediately, within the withdrawal period. If you withdraw, we refund what you paid minus a proportionate amount for the days already provided.
  • Credit packs: if you withdraw within 14 days, we refund the value of the unused credits from that pack.
  • Refunds are made within 14 days of receiving your request, using the same payment method, at no extra cost to you.

Businesses

For businesses, amounts paid are not refundable, except where the law requires it or in case of a billing error on our side.

8.Public API and acceptable use

  • API access uses API keys created on the Developers page (/developer), sent in the X-API-Key header. A key is shown only once; keep it secret and revoke it if it is exposed.
  • Each key has a rate limit (10 requests per second by default). We may adjust limits to protect the stability of the Service.
  • Webhooks are sent to the URLs you configure, signed with HMAC-SHA256. You are responsible for the security of your endpoint; after repeated failures an endpoint is disabled automatically.

You must not:

  • resell, redistribute in bulk or make the data available to third parties as a competing service, API or dataset;
  • scrape the website, the app or the directory outside the API, or bypass rate limits, credits or other technical measures;
  • use the Service to track, harass or monitor individuals, or for unlawful purposes (including evading international sanctions);
  • test the security of the Service, upload malicious code or overload the infrastructure without our written consent;
  • decompile or copy the Service, except where the law expressly allows it.

You may use API results in your own applications and business processes, provided you respect the rules above.

9.Intellectual property

The Service — its code, design, texts, the Wingo Marine brand and the compilation of the data — belongs to Freevox or its licensors. We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service under these terms.

AIS data is broadcast publicly by ships; data taken from third parties remains subject to their terms. Maps use data © OpenStreetMap contributors (ODbL licence).

The data you enter (fleet names, labels, webhook URLs) remains yours; you allow us to process it only as needed to provide the Service to you. We may freely use suggestions and feedback you send us to improve the Service.

10.Availability and changes to the Service

We make reasonable efforts to keep the Service available at all times, but we do not guarantee uninterrupted operation: there may be maintenance, faults or outages of the data sources. We offer no guaranteed service level (SLA) unless agreed separately in writing.

We may develop, change or withdraw features. If a change significantly reduces what you paid for in an active plan, we will tell you in advance and you may cancel; consumers keep their statutory rights for digital services (Government Emergency Ordinance no. 141/2021).

11.Liability

The Service is provided “as is”. To the extent permitted by law, we do not warrant that the data is complete, accurate or current, and we are not liable for decisions taken solely on its basis (see “AIS data: important limits”).

Towards businesses, Freevox’s total liability for any claim related to the Service is limited to the amounts you paid in the 12 months before the event, and Freevox is not liable for indirect damage, loss of profit, data or opportunity.

Nothing in these terms limits liability for intent or gross negligence, for death or personal injury, or the rights consumers have by law (including the legal guarantee of conformity for digital services).

If you use the Service as a business and breach these terms or the law (for example by abusing the API), you will indemnify us for third-party claims and reasonable costs arising from it.

12.Suspension and termination

  • You may stop using the Service at any time. To delete your account, write to us from the account’s email address at office@freevox.ro; cancel any active subscription first.
  • We may suspend or close an account, with notice (or without, when urgent), if you breach these terms, do not pay, an authority requires it or there is a security risk.
  • On termination, API keys are revoked, webhooks stop and the remaining credits are lost, except for refunds required by law or by these terms. Data is deleted as described in the Privacy Policy.

13.Personal data and cookies

How we process personal data is described in the Privacy Policy; cookies and local storage in the Cookie Policy.

14.Changes to these terms

We may update these terms. The date of the last update is shown at the top of the page. For material changes we will notify you by email or in the app at least 30 days before they take effect. If you do not agree, you can cancel your subscription and close your account; continuing to use the Service after they take effect means you accept the new version.

15.Governing law and disputes

These terms are governed by Romanian law. We first try to settle any complaint amicably: write to us at office@freevox.ro and we will reply within 30 days.

  • Businesses: disputes not settled amicably fall under the jurisdiction of the courts of Bucharest, Romania.
  • Consumers: you may bring a claim before the court that has jurisdiction by law, including the court where you live, and you keep the protection of the mandatory rules of your country of residence.
  • Consumers may contact the Romanian National Authority for Consumer Protection (ANPC) or an alternative dispute resolution body (SAL). For cross-border disputes within the EU you can ask the European Consumer Centre Romania for help.
  • The European Online Dispute Resolution (ODR) platform was closed on 20 July 2025 (Regulation (EU) 2024/3228), so we can no longer refer you to it.

16.Final provisions

  • These terms, together with the Privacy Policy, the Cookie Policy and the prices shown when you order, are the entire agreement between us.
  • If a clause is held invalid, the others remain in force. Not exercising a right is not a waiver of it.
  • We may transfer the contract to a company that takes over the Service, with notice to you; you may not transfer it without our consent.
  • These terms are available in Romanian and English; if they differ, the Romanian version prevails.
